1. Agreement

These Terms of Service ("Terms") are an agreement between you and Integral Technologies ("we", "us", "our"), the owner and operator of kaki games, covering your use of the kaki games app, the kaki games website, and everything we offer through them (together, "kaki games").

By opening kaki games or playing a round, you accept these Terms. If you do not accept them, do not use kaki games.

Our Privacy Policy explains how we handle your information and forms part of these Terms.

2. Who can use kaki games

You must be at least 13 years old. If the country you live in sets a higher minimum age for a service like this — up to 16 in parts of the European Economic Area — you must meet that age, or have your parent or guardian's permission.

If you are under the age of majority where you live, your parent or guardian must review and accept these Terms with you. They are responsible for your use of kaki games, including any purchases made on their device.

You also confirm that you are not barred from using kaki games under any applicable sanctions or export control law.

3. Your account

Playing anonymously. You can play without an account. Anonymous progress lives on your device and is tied to it. We cannot identify it, transfer it, or recover it — if you lose or reset the device, or delete the app, that progress is gone. That is the trade-off for a zero-friction start, and we would rather tell you plainly than have it surprise you.

Signing in. You can create an account with Google, Apple, or a one-time email code, and your existing progress attaches to it. You agree to give accurate information, to keep control of the email address and sign-in method you use, and to tell us if you think someone else has access to your account.

Usernames. Your username is public and must be unique across kaki games. It must follow the content rules in section 11. We may refuse, change, or reclaim a username that breaks those rules, impersonates someone, is held purely to prevent others using it, or belongs to a long-inactive account.

One account per person. Do not create multiple accounts to appear more than once on a leaderboard, farm rewards, evade a suspension or a block, or influence party results. Do not share, sell, rent, or transfer your account.

You are responsible for activity under your account, except to the extent it results from something we did wrong.

4. Licence to use kaki games

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use kaki games on devices you own or control, for your own non-commercial entertainment.

You may not: copy, modify, translate, or create derivative works of kaki games; reverse engineer, decompile, or disassemble it, except to the extent the law expressly permits and we cannot contractually prevent; rent, lease, lend, sell, sublicense, or distribute it; remove or obscure any proprietary notice; or use it to build a competing product.

5. How the games work

kaki games generates levels on a curve rather than offering a fixed list. Progression, difficulty, Brain Points, badges, leaderboards, and the energy economy are part of a live service that we tune over time. We may adjust difficulty curves, point values, energy rates, rewards, and rules — including through updates that change how a game you have been playing behaves.

We will try not to do anything that feels like taking something away from you, but we cannot promise that a specific level, score, difficulty, or reward will stay exactly as it is.

Practice mode lets you replay levels below your best. By design, it does not earn Brain Points.

6. Virtual items, points, and rewards

Brain Points, levels, streaks, badges, energy, attempts, cosmetic skins, and avatars are "virtual items."

• Virtual items have no monetary value. They are not currency, credit, property, or a financial instrument.
• You get a limited licence to use them within kaki games. You do not own them.
• They cannot be sold, traded, transferred, gifted, or exchanged for money or anything of value, inside kaki games or outside it.
• They cannot be redeemed for cash and are not refundable, except where consumer law requires otherwise.
• We may modify, suspend, or remove virtual items, or change how they are earned and priced, as part of running the service.
• Limited-edition badges are exactly that. Once an edition closes, we are under no obligation to offer it again.
• If your account is terminated or deleted, your virtual items go with it and are not refunded.

7. Purchases

kaki games is free to play, and everything essential to playing is available without paying.

How purchases work. Optional purchases — Remove Ads, cosmetic packs, energy bundles — are made through the Apple App Store or Google Play, not directly with us. Your payment relationship for those transactions is with Apple or Google, under their terms, and they process your payment details. We never see them.

Pricing. Prices are shown in the app before you confirm, and include or exclude tax according to the store's rules for your country. We may change prices; a change never affects something you have already bought.

Refunds. Because Apple and Google handle the transactions, they handle refunds — through Apple's "Report a Problem" page or your Google Play order history. We cannot issue refunds directly, but if something on our end failed to deliver, book a call with us and we will make it right or support your claim with the store. Nothing here limits any statutory refund right you have under consumer law, including the EU and UK right to cancel a digital purchase within 14 days where that right applies.

One-time, not a subscription. kaki games has no subscription. Purchases are one-off and do not renew.

Restoring. You can restore eligible non-consumable purchases in Settings. Sign in to your kaki games account so that purchases follow your profile.

8. Ads

kaki games shows rewarded video ads. They are always opt-in — you choose to watch one in exchange for continuing a round. We do not interrupt gameplay with unrequested ads.

Ads come from third-party networks. We do not control, endorse, or take responsibility for their content or for the products they advertise, and your dealings with an advertiser are between you and them. If an ad is broken, offensive, or fails to grant your reward, tell us.

You may remove ads with a one-time purchase.

9. Fair play

kaki games is a game about beating your own best, and the leaderboards only mean something if they are honest. You agree not to:

• Cheat, exploit bugs, or use scripts, bots, macros, automation, modified clients, or input-assist tools.
• Tamper with the app, its data, its network traffic, or your device clock to affect scores, streaks, energy, attempts, or rewards.
• Use emulators, remote-control software, or hardware designed to produce inhuman reaction times or inputs.
• Create or use multiple accounts to influence leaderboards or party results.
• Collude with other players to fix the outcome of a party match.
• Access kaki games through anything other than the official app, or attempt to reach another player's account or our systems without authorisation.
• Scrape, crawl, or bulk-collect data from kaki games, or overload our infrastructure.

If we reasonably believe you have done any of this, we may reset or remove your scores, points, streaks, or badges, remove you from leaderboards, revoke virtual items, restrict features, or suspend or terminate your account. Where the circumstances allow, we will tell you why and give you a way to respond.

10. Community conduct

kaki games has other people in it — leaderboards, follows, parties. Keep it decent. You agree not to:

• Harass, threaten, bully, or stalk another player, including by following them, joining their parties, or using new usernames to get around a block.
• Post or transmit hateful, discriminatory, sexually explicit, violent, or illegal content anywhere it can be seen by others.
• Impersonate another player, us, or our staff.
• Solicit, advertise, spam, or attempt to sell anything to other players.
• Share another person's personal information without their permission.
• Misuse the reporting system with knowingly false reports.

Blocking and reporting. You can block any player, which removes them from your experience, and report any player for review. Blocking someone does not notify them. We review reports and may act on an account, but we are not obliged to reach a particular outcome or to tell you what we decided about someone else's account.

11. Your content

What you provide. Your username, avatar image, and anything else you submit is "your content."

Licence. You keep whatever rights you have in your content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display it as needed to operate kaki games — for example, showing your username and avatar on a leaderboard or in a party lobby. This licence ends when you delete the content or your account, except for copies already distributed to other players and backups pending deletion.

Your promises. You confirm that you have the right to submit your content and that it does not infringe anyone else's rights. Do not upload an avatar you do not have the rights to.

What is not allowed. Usernames, avatars, and any other content must not be sexually explicit; hateful, harassing, or discriminatory; violent or threatening; illegal or promoting illegal activity; impersonating anyone; or the intellectual property of someone else without permission.

Enforcement. We may remove or change content that breaks these rules, and act on the account behind it. We are not obliged to monitor content, but we may.

12. Party mode and other players

Party mode connects you live with other people, including people you do not know if you join through a shared link. Other players are responsible for their own behaviour, not us. Be decent, do not share personal information you would rather keep private, and report anyone who behaves badly.

Party rounds use a fixed number of attempts with no continues, so that nobody stalls the match. Party size, scoring, and bonus Brain Points for top finishers are set out in the app and may change.

We cannot guarantee that a party will start, run without interruption, or finish — live multiplayer depends on your connection, your friends' connections, and ours. If you or another player loses connection, the match may continue without that player, and results may be recorded as they stood at the point of disconnection.

13. Our intellectual property

kaki games — including the games, their rules and difficulty systems, code, artwork, badge and gem designs, sound, music, haptics, copy, the kaki games name, and our logos — belongs to us or our licensors and is protected by intellectual property law. These Terms give you a licence to play and nothing more. All rights not expressly granted are reserved.

If you send us feedback, ideas, or suggestions, we may use them freely and without owing you anything. Please do not send us anything you consider confidential or expect to be paid for.

14. Availability and changes

We work to keep kaki games available, but we do not promise that it will be uninterrupted, error-free, or available in every country. We may:

• Update, change, or discontinue features, games, or the whole service.
• Take kaki games down for maintenance.
• Stop supporting older app versions or operating systems.
• Discontinue kaki games entirely, in which case we will give reasonable notice in the app where we can.

Solo play works offline and syncs when you reconnect. Leaderboards, follows, party mode, purchases, and ads need a connection, and we are not responsible for your network. We are not liable for progress that fails to sync because of a device fault, a storage failure, or an app deletion before syncing.

15. Ending things

You can leave whenever you like. Delete your account in Settings → Account → Delete Account, or simply uninstall the app. Deletion is permanent: your profile, progress, points, streak, badges, follows, and virtual items are removed and cannot be restored, and purchases are not refunded.

We can end your access if you break these Terms, if we are legally required to, or if we discontinue kaki games. Except where a serious breach or a legal obligation makes it impractical, we will give you notice.

After termination, your licence ends and your virtual items are forfeited. Sections 6, 13, 16, 17, 18, 19, and 24 survive.

16. Disclaimers

kaki games is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory — including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that kaki games will meet your requirements, that it will be secure or uninterrupted, or that defects will be fixed.

On brain training specifically: kaki games is a game, made for entertainment. We make no claim — and you should not infer one — that playing it improves your memory, attention, reaction speed, intelligence, cognitive performance, or brain health, or that it prevents, diagnoses, treats, or mitigates any medical or cognitive condition. kaki games is not a medical device, an assessment tool, or a substitute for professional advice. If you have concerns about your memory, attention, or cognition, please speak to a qualified healthcare professional.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here affects your non-waivable statutory rights as a consumer.

17. Limitation of liability

To the fullest extent the law allows:

• We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost progress, lost virtual items, or loss of goodwill, however caused and on any theory of liability.
• Our total aggregate liability arising out of or relating to kaki games or these Terms is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD 50 or its equivalent in your local currency.

These limits apply even if we were advised that the damages were possible, and even if a limited remedy fails of its essential purpose.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. If you are a consumer in the EU or the UK, you keep all of your mandatory statutory rights and remedies, and this section applies only to the extent the law permits.

18. Indemnity

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, damages, losses, and reasonable costs, including legal fees, arising from your breach of these Terms, your content, or your unlawful use of kaki games. We will tell you promptly about any such claim and let you participate in its defence; you will not settle anything that imposes an obligation on us without our agreement.

19. Disputes and applicable law

Talk to us first. Before starting any formal proceedings, please book a call and tell us what has gone wrong: Contact us. Most problems are faster to fix in a conversation than in a courtroom, and we will make a real effort.

If you are a consumer, these Terms are governed by the law of your country of residence, and you may bring proceedings in the courts of that country. Nothing in these Terms deprives you of the protection of the mandatory consumer law where you live, or of your right to complain to a consumer protection authority there.

If you are not a consumer — for example, if you use kaki games in the course of a business — any dispute will be resolved by the courts of the country in which Integral Technologies is established at the time the dispute arises, and you agree to their jurisdiction.

Neither party gives up the right to seek urgent injunctive relief from any court with jurisdiction to protect intellectual property or prevent ongoing harm.

20. Apple App Store terms

This section applies if you obtained kaki games from the Apple App Store, and takes precedence over anything inconsistent with it elsewhere in these Terms.

1. These Terms are between you and us only, not with Apple. Apple is not responsible for kaki games or its content.
2. The licence in section 4 is limited to a non-transferable licence to use kaki games on any Apple-branded product you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, and may be accessed by other accounts via Family Sharing or volume purchasing where applicable.
3. Apple has no obligation to provide maintenance or support for kaki games.
4. If kaki games fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to kaki games, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
5. We, not Apple, are responsible for addressing any claim by you or a third party relating to kaki games or your use of it, including product liability claims, claims that kaki games fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
6. If a third party claims that kaki games infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of that claim.
7. You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
8. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.

21. Google Play

If you obtained kaki games from Google Play, your use is also subject to the Google Play Terms of Service. These Terms are between you and us, not Google. Google is not responsible for kaki games, and handles purchases and refunds under its own terms.

23. Changes to these Terms

We may update these Terms. If a change is material we will notify you in the app before it takes effect and give you a reasonable chance to review it. Continuing to use kaki games after a change takes effect means you accept the updated Terms; if you do not, you can delete your account. The "last updated" date at the top always reflects the current version.

24. General

Language. These Terms are drafted in English. French and Spanish translations are provided for convenience. Where you are a consumer and the law of your country requires these Terms to be provided in your own language, the version in that language applies to you.

Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about kaki games, and replace anything said before.

Severability. If a provision is found unenforceable, the rest stays in force, and that provision is limited or removed to the minimum extent necessary.

No waiver. If we do not enforce something straight away, we have not given up the right to enforce it later.

Assignment. You may not assign or transfer these Terms. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.

No agency. Nothing here creates a partnership, employment, agency, or joint venture between us.

Force majeure. Neither of us is liable for a failure to perform caused by events beyond reasonable control.
